These Terms and Conditions ("Terms") govern your use of the website www.kcaluscape.com.au (the "Site"), which is owned and operated by KC ALUSCAPE PTY LTD ("we", "us", or "our").

Company: Refers to KC ALUSCAPE PTY LTD

Client: Refers to the person/entity that orders/purchases goods and/or services from the Company.

By accessing or using this Site, or by engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Services

We offer aluminium fabrication, fencing and gate installation and related services in Brisbane and surrounding areas. All services are subject to availability and a formal quote.

2. Quotes Validity and Pricing Terms

Quotes are valid for 14 days from the date issued, unless otherwise stated in writing. After this period, the Company reserves the right to amend pricing and terms.

Prices are subject to change due to fluctuations in material costs or unforeseen site conditions. Final costs will be confirmed prior to the commencement of any work.

Any material upgrades or changes requested by the Client must be submitted in writing and approved by the Company. Such changes may incur additional charges.

3. Payments, Non-Payment and Repossession Right

Payments must be made as agreed in the quote or contract (e.g. deposit and balance on completion). Late payments may incur fees. We may terminate the contract for non-payment by the Client/you after giving 7 days of written notice/ invoices.

All installed goods remain the property of the Company until full payment is received. The Client acknowledges and agrees that ownership rights are retained by the Company until payment is made in full.

In the event of non-payment, the Company reserves the right to enter the Client’s property to repossess any installed goods. The Client grants the Company an irrevocable license to access the premises for this purpose.

The Company will not be liable for any damage incurred during the repossession process, except where such damage is caused by the Company's negligence.

4. Cancellations, Returns and Refunds

Any customized items/products are non-refundable.

Please provide at least 48 hours' notice if you need to cancel or reschedule. Cancellations within the production/fabrication process or after materials have been purchased will be denied or may incur a restocking fee.

You may return any non-customized products that didn’t match the item description or have any deflect. You must notify us within (7) days of purchase/delivery if you wish to get a refund on any eligible items. Please allow us up to 10 business days to process the refund, with postage cost at your expense.

5. Warranty

- Coverage

• Structural Warranty: A 5-year warranty applies to defects in materials or workmanship relating to the gate frame, welding, and structural integrity under normal use.

• Moving Parts: A 12-month warranty applies to defects in materials or workmanship for moving parts, including tracks, rails, motors, and related components.

- Exclusions
This warranty does not cover:

• Cosmetic wear on any parts of the product, including surface scratches occurring under normal use.

• Damage or faults resulting from misuse, neglect, accidents, unauthorised modifications or repairs.

• External factors including (but not limited to) natural disasters, vermin, or improper installation not performed by our team.

- Maintenance Obligations
The Client is responsible for regular maintenance of the product, including cleaning, debris removal, and periodic lubrication of moving parts (where applicable). Evidence of maintenance may be required to validate a warranty claim.

- Warranty Period
Warranty begins on the earlier of:

• The date of installation completion; or

• The date of final payment.

- Limitations
This warranty covers parts only and is non-transferable unless otherwise agreed in writing. Labour and call-out fees for warranty service may be charged at our discretion.

6. Limitation of Liability

We are not liable for any indirect, incidental, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of this website or our services.
Our total liability is limited to the amount you have paid us for the relevant goods or services.
This limitation applies to the fullest extent permitted by law and includes liability of our directors, officers, employees, contractors, and affiliates.

7. Website Use

All content on this site is owned by us or used with permission. Do not copy, reproduce, or republish without consent. All content published on our Site is the property of KC ALUSCAPE PTY LTD. This includes, but not limited to Our images, text, writings, graphics, logos, and other materials that form part of the site's design and content.

You are not granted any rights to use, reproduce, copy, distribute, or republish any part of this content without our prior written consent. All rights are reserved.

The Company is not liable for any consequential or indirect loss or damage, including but not limited to loss of profits, arising from delays, defects, or any other circumstances beyond the Company’s reasonable control. The Client acknowledges that they have relied on their own judgement in selecting products or services to meet their specific requirements.
